These Terms of Service ("Terms") are a legal agreement between you and Psilly Goose Inc. ("Psilly Goose," "we," "us," or "our") governing your access to and use of https://drinkpsilly.com/ and any site, app, or service that links to these Terms (collectively, the "Site"), as well as any products ("Products") and services we provide through the Site (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy & Cookie Policy, Consumer Advisory, Age Verification Policy, Shipping Policy, and Refund Policy, which are incorporated by reference.
ARBITRATION NOTICE & CLASS ACTION WAIVER: Except for certain types of disputes described below, you agree that disputes between you and Psilly Goose will be resolved by binding, individual arbitration, and you waive your right to a jury trial or to participate in a class action.
The Site and Products are intended only for adults 21 years of age or older. By using the Site or Services, you represent that you are at least 21 and capable of entering a binding contract. We may verify age and refuse or cancel orders that fail age/ID checks.
Some Products may be restricted or unavailable in certain jurisdictions. You are solely responsible for complying with applicable laws where you access, possess, use, or ship Products. We may geoblock or refuse orders that do not comply with law.
Products may contain hemp-derived cannabinoids and can cause impairment. Do not drive or operate machinery. Keep out of reach of children and pets. Not evaluated by the FDA and not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional before use, especially if pregnant, nursing, on medications (including SSRIs/SNRIs/MAOIs), or with medical conditions. Use may result in a positive drug test.
You may be required to create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of unauthorized use.
Your order is an offer to buy; we may accept or decline at our discretion.
We may reject or cancel orders that fail age/ID verification, fraud screening, payment authorization, or geographic/legal restrictions.
Prices, taxes, shipping, and promotions may change without notice (changes apply prospectively).
Title and risk of loss pass to you when we transfer Products to the carrier. Shipping dates are estimates.

You may use the Site only for its intended purpose and in compliance with law. You agree not to:
violate laws or third-party rights (IP, privacy, publicity);
attempt to gain unauthorized access, introduce malware, or scrape/crawl except via publicly available interfaces;
engage in fraud, misrepresentation, or resale where prohibited;
interfere with Site operation, security, or others' use.
We may monitor, suspend, or terminate access for violations.
The Site, Services, and all content (text, graphics, software, logos, etc.) are owned by Psilly Goose or licensors and protected by IP laws. Except as permitted by law or these Terms, you may not copy, modify, distribute, or create derivative works.
If you submit reviews, comments, media, ideas, or other content ("User Content"), you grant Psilly Goose a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and perform that User Content in connection with the Site and our business. You represent you have rights to grant this license and your User Content is lawful and accurate. We may remove User Content in our discretion.

We do not warrant uninterrupted or error-free operation or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSILLY GOOSE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE/GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $1,000 OR THE AMOUNT YOU PAID TO PSILLY GOOSE FOR THE PRODUCT OR SERVICE AT ISSUE.
Some jurisdictions do not allow certain limitations; some limitations may not apply to you.
You agree to indemnify and hold harmless Psilly Goose and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site/Services/Products, or your User Content.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to the Arbitration section below, the exclusive venue for any action not subject to arbitration is the state or federal courts located in Los Angeles County, California, and you and Psilly Goose consent to personal jurisdiction there.
Informal Resolution. Before filing a claim, the party seeking relief must first email legal@drinkpsilly.com with a brief description of the dispute and contact information. If we cannot resolve it within 30 days, either party may commence arbitration.
Arbitration Agreement. Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms or the Site, Services, or Products (collectively, "Claim") will be resolved by binding arbitration before the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Los Angeles County, California, unless we agree to conduct it remotely.
Costs & Fees. AAA filing, administration, and arbitrator fees are governed by the AAA Rules. If your Claim is $10,000 or less, we will pay your share of AAA fees unless the arbitrator finds your Claim frivolous. Each party bears its own attorneys' fees unless applicable law provides otherwise.
Arbitrator's Authority. The arbitrator may award individual relief available in court, including statutory damages and attorneys' fees, consistent with applicable law. The award is final and may be entered in any court of competent jurisdiction.
Exceptions. Either party may (a) bring an individual action in small-claims court; (b) seek injunctive relief in court for allegations of intellectual-property misuse or unauthorized access/misuse of the Services; and (c) file a complaint with a government agency.
Class Action Waiver. Claims must be brought on an individual basis. No class, collective, representative, or private attorney general actions. The arbitrator may not consolidate claims of multiple persons.
30-Day Opt-Out. You may opt out of arbitration by emailing legal@drinkpsilly.com within 30 days of first accepting these Terms with: (i) your full name, (ii) the email used for your account or order, and (iii) a statement that you opt out of arbitration.
Severability. If the Class Action Waiver is found unenforceable as to a particular claim, that claim must proceed in court (not arbitration).

We may modify the Site, Services, Products, or these Terms at any time. Changes are effective upon posting (the "Last Updated" date will change). Your continued use after changes means you accept them.
By using the Site or Services, you consent to receive communications from us electronically and agree that electronic signatures and records satisfy any legal requirements for a signature or writing.
If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms, together with the incorporated policies, are the entire agreement between you and Psilly Goose regarding the Site and Services and supersede prior agreements.

By purchasing as a wholesale account, you agree to these Wholesale Terms and the main Terms above.
We use commercially reasonable efforts to ship orders received by 11:00 a.m. PT the same business day, otherwise next business day. Carriers may include USPS/UPS or alternatives. Title and risk of loss pass to you upon tender to the carrier. We may refuse orders to jurisdictions where Products are restricted.
You must inspect Products upon delivery. Products are deemed accepted unless you provide written notice of non-conformity within 5 business days of delivery with reasonable documentation.
For timely, valid non-conformity claims, Psilly Goose may, at its option, repair, replace, or refund the purchase price for affected Products. This is your exclusive remedy.
You represent you have all required licenses/permits to purchase, store, and resell Products and will comply with all laws (including age restrictions). You will not resell Products in jurisdictions where prohibited.
EXCEPT AS EXPRESSLY PROVIDED, PRODUCTS ARE SOLD "AS IS." PSILLY GOOSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT will Psilly Goose's liability arising out of or related to the Products exceed the amounts paid for the specific Products giving rise to the claim. NO liability for lost profits or consequential damages.
You will indemnify, defend, and hold harmless Psilly Goose from claims arising from your storage, handling, marketing, or resale of Products, except to the extent caused by Psilly Goose's willful misconduct.
Wholesale returns are accepted for items defective or damaged on arrival
within 30 days of delivery. All other returns are at our discretion. Items must
be in original condition and packaging with proof of purchase. Contact
